Description
With the accession of the Republic of Croatia to the EU and the growing cross-border exchange of goods and services and the movement of people within the EU, the aim of the course is that by studying the subject matter, students gain knowledge and skills for their future professional work.
By studying the subject of the Tort Conflicts in European Private International Law, students acquire general and special knowledge in the correct application of the applicable law for non-contractual liability for damage in cross-border and international private law situations. In addition to the creation and adopted provisions of the Rome II Regulation, the comparative provisions of the autonomous national law of the Member States of the European Economic Area, as well as those contained in the rules of the Hague Convention on the Law Applicable to Traffic Accidents of 1971, and the Hague Convention on the Law Applicable to Products Liability of 1973 and the European civil procedure law contained in the Brussels Ibis Regulation governing jurisdiction for non-contractual relations with a cross-border and / or international character are studied. Understanding of the mentioned rules of European secondary law that is directly applicable in the Croatian legal system is very important in its general legal and practical significance and an indispensable element in the knowledge of each student when determining the applicable law referred to by the provisions of the PIL, as well as when pre-determining international jurisdiction to resolve such disputes. In addition to the above knowledge, students acquire other specific knowledge related to the general provisions and basic notions of PIL, such as overriding mandatory rules and public policy, rules of safety and conduct, direct action, renvoi and application of law of a state with a non-uniform legal system et al., in the same context as in general PIL.
