Description
In the field of tort law, a prominent place belongs to the matter of liability for damages in medicine. Despite the fact that medical law is still largely governed by the general rules of tort law, a proper understanding of the field requires knowledge of a number of elements. This applies, inter alia, to the presumptions of liability for damages, which are essentially general presumptions of liability for damages, but in the field of medical indemnification law they have special names (eg medical error and treatment without consent). Also, there are some peculiarities in relation to the right to repair damages, which also includes some new trends related to the system of liability for damage (so-called no-fault systems). In addition, in addition to the general subject (Civil Law I: General Part and Law of Obligations), which deals with general liability for damages, and individual elective cases dealing with different parts of medical law, none of them deals fully with the institute of liability for damages in medicine. Therefore, the subject of medical tort law should cover all civil law aspects of liability for damages in medicine.
