Description:

Understanding the EU internal market law is the key to understanding how the EU really works. This course focuses on the four fundamental market freedoms that represent the cornerstone of EU integration - free movement of goods, persons, services and capital. The course also covers EU citizenship and analyses difficulties in striking the appropriate balance between the interests of the internal market, on the one hand, and national regulatory autonomy, on the other.

Cognitive Skills:

Knowledge abd understanding

- to understand economic, political and social circumstances in which EU internal market law operates

- to distinguish fundamental market freedoms

- to understand the scope of application of freedom of movement of goods, persons, services and capital

- to know how to group and compare types of justification for measures that restrict market freedoms

- to understand and apply proportionality test

- to recognise and explain the bortderline between market freedoms and rights ensured by European citizenship

- to distinguish powers of the EU and member states in the areas relevant for market functioning

 

Practical and Generic Skills:

Legal, practical and communication skills

- to recognise a legal problem from the field of internal market law (problem identification)

- solve a legal problem from the field of internal market law by the application of principal and subsidiary sources of EU law, in particular the practice of the European Court

- to propose a possible future development of the practice of the European Court in this area or to recommend passing new Wuropean legislation

- to analyse and evaluate possible contrary interpretations of the Treaty provisions in the field of internal market law, and to identify their advantages and disadvantages

- to present argumented legal opinions relevant for internal market and substantiated by legal sources

- to articulate and express ideas in an appropriate and clear manner, especially to create an order of arguments and present them in a logical and legally consistent form

- to read and understand complex legal materials in the field of internal market law

to apply communication skills in various situations, to present arguments from the position of parties in national proceedings, the European Commission, advocate general and the European Court
