Description:

The narrow and broad concept of police and internal affairs. The development of police as an administrative branch with particular emphasis on Croatia. (6h) The sources of the police law (the Constitution, laws, international agreements, administrative decisions, judicial and administrative practice, common law). (2h) Organisation of the internal affairs in the Republic of Croatia. The relations between the administrative bodies in charge of internal affairs. Relations with representative bodies, executive bodies, judiciary (courts and General Attorney s Office), legal entities with public authority, and Ombudsman. (2h) Relations between physical and legal entities and administrative bodies in charge of internal affairs. Administrative supervision and judicial review. (4h) Rights and obligations of the physical and legal entities with regard to the administrative bodies in charge of internal affairs: status matters (citizenship, domicile, identity card, passports of the Croatian citizens), matters considering weapons possession, explosives, transportation of hazardous material, etc. Procedures related to the stated rights and obligations. (4h) Rights and obligations of the foreign citizens and administrative bodies in charge of internal affairs (crossing of the state border, passports belonging to the foreign citizens, movement and sojourn of the foreign citizens in the Republic of Croatia, residence permits, resident aliens, denial of residence permit, control) with regard to the legal system of the European Union. (2h) The right of asylum. Procedures considering the right to asylum: granting of the asylum. Rights and obligations of the internal affairs in relation to the asylum seekers. (2h) Police competences in relation to public assembly, peaceful demonstrations, and other forms of expressing public opinion in public places. (2h) State border and the control of state borders (the concept of state border, border crossings, border crossing control, passports, limitations of property rights and other rights in border area). (4h)

Knowledge and understanding

After successfully completing the course, students will be able to:

- define basic institutes of police administrative law

- critically evaluate and recognise different types of police categories

- explain the organisation of police in Croatian law

- explain police powers and tasks

- explain a series of decisions in the area of personal status of citizens

 

Application

After successfully completing the course, students will be able to:

- group and describe different police powers

- apply acquired knowledge and the importance of police in a modern state administration

- use knowledge about the rights of citizens in the area of police administrative law

 

Analysis

After successfully completing the course, students will be able to:

- analyse the consequences of unlawful work of police;

- distinguish individual acts that are made in the series ofprocedures conducted by the police;

- analyse legal protection of the rights of citizens in procedures before the police;

- compare the need to realise public interest and protection of individual rights of citizens;

- analyse the significance that administrative law protection has in administrative matters in which the police decide about the rights of citizens.

 

Synthesis

After successfully completing the course, students will be able to:

- independently construct different procedures that the police conducts (issuance of personal documents, passports, licenses for arms)

- distribute the roles of individual organisational units within the police and their powers in performing police tasks;

- examine the application of appropriate sources of police administrative law to a concrete case;

- evaluate different cases of unlawfulness in the police actions in administrative matters;

- assess correctness of police actions in deciding about the rights of citizens.

 

Evaluation

After successfully completing the course, students will be able to:

- examine the organisation of police and its purposefulness;

- compare powers of the police with the level of protection of the rights of citizens;

- evaluate the significance of the protection of the rights of citizens in the area of police administrative law, especially with regard to the protection of the rights guaranteed by the Constitutions (the right to a peaceful protest etc.)

- assess legality of police work in individual cases.

Practical and Generic Skills:

After successfully mastering the course, students will be able to:

- clearly and precisely exprewss themselves, presenting acquired learning outcomes;

- orally present acquired learning outcomes;

- independently lead administrative procedures from the area of police administrative law;

- argument their opinions about police administrative law issues.
