Description
The aim of the course is to acquaint students with the international private law of family and succession relations, especially with the sources of the European Union and the international treaties of the Hague Conference. This upgrades the basic knowledge acquired in the compulsory subject Private International Law. The importance of the course is that today, given the growing number of cross-border movements of persons, family relationships and succession are increasingly international in nature and this course will provide students with knowledge that will be useful in professional life after graduation.
By studying the subject Private International Law in Family and Succession Matters, students acquire general and special knowledge on determining international jurisdiction and applicable law, as well as on the recognition and enforcement of decisions in family and succession matters. The relationship between the regulations of the European Union and the Hague Conference is being studied in particular, especially in the context of maintenance and international child abduction. Students acquire special knowledge in the field of marriage and divorce and marital property relations with an international character, the relationship between parents and children with special emphasis on international child abduction. In addition, special knowledge is acquired in terms of maintenance and adoption with an international element, as well as succession with an international element. Specific issues to be addressed include, inter alia, the determination of habitual residence (especially of a child), cross-border recognition of marriage and other legal and life unions, the application of renvoi in family and succession cases, determination of public policy in accordance with the case law of the CJEU and influence of the ECtHR case law in matters of adoption with an international element.
