Description:

The concept, subject, tasks and methods of criminal science. Heuristic, syllogistic, repressive, preventive, theoretical and practical criminal science. Criminalistic phenomenology, tactics, technique and methods. Gnostic contents of criminal science. Criminal science, criminal law and criminal proceedings. Criminal science and other scientific disciplines. Sources of evidentiary facts on legally relevant facts: leads and objects, persons, documents. technical recordings of facts. Criminal concepts within the methodology of criminal inquiry and the language of criminal science. Criminal inquiry as a system. The contents of criminal inquiry: aim and object of procedural inquiry, guidelines in explanation and inquiry, criminal situations, operative and guarding situations, criminal-tactical manners of inquiry. Operational police activity: concept, role, tasks and means of operative-evidential activities of the police (criminal control and investigation). Operational analysis of criminal measures and acts. Methodology of criminal investigation: criminal differential diagnosis, criminal process of thought, flow-charts of criminal investigation, operational-procedural systems. Methodical approach to the investigation of individual categories of criminal offences (criminal methodology): investigation of the course of a criminal offence commitment, flow-charts of applicable investigation programs, operational analysis focused on the cause-and-effect relation, investigation of the forms of guilt, characteristics of individual categories of criminal offences, syllogistic aspects of the technology of criminal offences. Criminal tactica-operational activities and measures (criminal tactics), criminal contents of the criminal activities (methods and means), the most frequent failures in their commitment, forms of communication between state punitive bodies. Case study.

Cognitive Skills:

After successfully completing the course, students will be able to:

- define basic concepts from the area of criminal science and criminal investigation;

- recognise characteristics of historical periods of criminalistic investigation and their influence on the modern development of methods;

- define the tactics of taking individual investigative, evidential and special actions in investigation of simpler cases;

- define scientific and technical methods needed to determine facts in criminal proceeding;

- compare the role of individual criminalistic actions in relation to the effects in the stage of disclosure and evidence;

- explain the factors that influence the level of solving criminal offences;

- select the subsequent manner of action depending on the quantity of information in the moment of report of a criminal offense in the area of property or blood offenses;

- present actions in the implementation of first measures on the crim scene;

- demonstrate abilities ofinvestigation of cases with deficient information from the area of corruption, organised or economic crime;

- categorise individual types of collected information about criminalistic action according to significance for proving certain types of cries;

- critically evaluate possibilities and scope of existing criminalistic-technical methods;

- analyse contents of the case file according to conducted actions and possible shortomings;

- indicate grave mistakes during criminalistic investigation;

analyse interrelation between the police, investigation officers and state attorney in the conduct of criminalistic actions;

- manage the implementation of actions through the co-operation between the state attorney and investigation officer;

- prepare a warrant for evidence and a request for special evidential actions;

- categorise possible faleshoods and mistakes that can results from certain actions;

- categorise the difficulties that lead to dropping of charges or indictment refusal;

- integrate coollected facts to draq an appropriate conclusion;

- connect the influence of prevention on the increase of the share of resolving criminal cases;

- assess the significance and validity of facts in individual stages of investigation;

- conclude about the importance of personal and material sources in the ruling;

- compare the difficulties in the investigation of different groups of criminal offenses;

- explain the influence of criminal science on the outcome of criminal proceeding.

After successfullly mastering the course, students will be able to:

- present the skills of managing information and adjusting to new situations;

- publicly present learning outcomes and critical abilities;

- develop skills of taking individual actions.

Active participation of student sis encouraged through practical work, examples from practice and disputable cases from domestic and foreign criminalistic practice;

- case studies are made to present the best practice in research;

- results of criminalistic investigation are connected with subsequent stages of criminal procedure;

- knowledge is tested during the classes through interaction with students.
